Terms & Conditions
1. About us
Evershade ("we", "us", "our") supplies and installs Royce Cube aluminium pergolas in Ireland. Contact: info@evershade.ie · +353 85 137 1046.
2. Quotes and orders
Prices shown on this website are guide prices. A firm quote is provided following a phone consultation and, where required, a site visit. Orders are confirmed in writing by email and require payment of a deposit. The balance is due on completion of installation.
3. Delivery and installation
We supply and install across Ireland. Lead times are typically several weeks from order to install, subject to manufacturer stock and weather conditions. We require clear access to the installation area and, unless otherwise quoted, a prepared level base (e.g. patio, deck or concrete pad). Groundworks are not included in our standard quote unless specifically agreed in writing.
4. Warranty
Product: the Royce Cube pergola is covered by a 5-year manufacturer warranty from Norfolk Leisure Lifestyle Ltd. Full warranty terms are supplied with the unit at handover.
Installation: our workmanship is covered for 12 months from the date of installation against defects in fitting. The warranty does not cover damage caused by misuse, weather events beyond the manufacturer's rated conditions, third-party modifications, or normal wear.
5. Cancellation
Under EU consumer protection law (S.I. No. 484/2013), where you have ordered as a consumer and the contract was concluded at a distance (e.g. by phone or email), you have a 14-day cooling-off period from the date of order to cancel without giving a reason. Cancellation must be requested in writing.
If installation has already commenced at your request within the cooling-off period, we may charge a reasonable amount for the work and materials already committed.
6. Limitation of liability
Our total liability under or in connection with any order is limited to the total price paid by you for the pergola. We are not liable for indirect, incidental or consequential losses, including loss of use, loss of profit, or loss of opportunity.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence.
7. Force majeure
We are not liable for delay or failure to perform caused by events outside our reasonable control, including extreme weather, manufacturer stock shortages, or supply chain disruption.
8. Governing law
These terms are governed by the laws of Ireland. Any dispute shall be subject to the exclusive jurisdiction of the Irish courts.
9. Changes to these terms
We may update these terms from time to time. The current version is always available at this URL with the "last updated" date shown above.
